Nintendo Files Lawsuit Against Yuzu Software Developer Tropic Haze

On February 26, Nintendo initiated a civil lawsuit against the software developer Tropic Haze. The lawsuit alleges that the team's technology enabled the illegal piracy of the 2023 game, The Legend of Zelda: Tears of the Kingdom, over a million times, weeks before its official release.

Allegations of Unlawful Circumvention

The suit, filed in the United States District Court of Rhode Island, accuses Tropic Haze's Yuzu of unlawfully bypassing Nintendo's protective measures. The software allegedly decrypts Nintendo Switch game files using an illicitly obtained copy of production keys, which are then distributed on illegal websites.

Nintendo's Stance on the Issue

Nintendo asserts that Yuzu turns ordinary computing devices into tools for vast intellectual property infringement. The software allegedly allows users worldwide to unlawfully decrypt and play virtually any Nintendo Switch game without payment. Nintendo emphasizes that there is no lawful way to use Yuzu to play its games and insists that the defendant must be held accountable for providing users with the means to infringe on Nintendo's intellectual property rights on such a scale.

Legal Action and Potential Damages

Nintendo is seeking legal action against Tropic Haze for trafficking in circumvention technology and unauthorized reproduction and distribution of protected works. The company is seeking $150,000 in damages, in addition to any extra damages and profits Yuzu gained from its violations. The case also includes the alleged $30,000 a month Tropic Haze earns from its Patreon, and the company insists that the developers face trial.

Previous Cases of Unlawful Emulation

This isn't the first instance of a Nintendo Switch game being emulated unlawfully. The 2021 side-scrolling action platformer Metroid Dread was illegally available online just days after its release. Despite reportedly being pirated over a million times, The Legend of Zelda: Tears of the Kingdom was still a significant success for Nintendo.
